HSAW Bill - Director Due Diligence

Factsheet – pending changes to Due Diligence 2026

There is a Bill before parliament to evolve the Health & Safety at Work Act 2015. In this Bill, there are various recommended changes to the legislation including that of Director / Officer duties commonly referred to as Due Diligence requirements.

The Bill proposes to provide an exhaustive list (rather than an inclusive list) to help manage the duty of Due Diligence. This change provides more clarity and removes ambiguity.

The following table lists the draft Due Diligence requirements with suggestions on how these are typically managed by Manage Group clients. This is not a complete list of suggestions but designed to give you an idea of how you would cover these.

Realistically, the Government will want this process completed prior to the elections in November 2026. As such, we anticipate that this will be introduced later this year circa September / October.
